California Implements New Rule: Clear Warning Labels for Hazardous Substances on Product Packaging
-California Updates Proposition 65 Warning Label Requirements:
Short-Form Labels Must Include Chemical Disclosure
On November 26, 2024, the California Office of Administrative Law (OAL) approved amendments proposed by the California Office of Environmental Health Hazard Assessment (OEHHA) to its Proposition 65 warning label regulations. These changes focus on improving consumer information, particularly for short-form warning labels.
Under the current rules, long-form warning labels must disclose at least one chemical of concern, while short-form labels are exempt from this requirement. The new amendment mandates that both long-form and short-form warning labels include at least one chemical name. This adjustment ensures that short-form labels also provide consumers with more detailed and effective information about potential exposure risks.
The updated regulations will take effect on January 1, 2025. However, businesses will have a three-year transition period to comply with the new short-form warning label requirements, making them mandatory by January 1, 2028.
OEHHA’s decision reflects a commitment to transparency and consumer protection, enhancing the utility of short-form warnings while allowing businesses sufficient time to adapt their labeling practices.

3.For Warnings About Exposure to Both Carcinogens and Reproductive Toxicants (Separate Chemicals):
WARNING [or CA WARNING or CALIFORNIA WARNING]: Risk of cancer from exposure to [name of chemical] and reproductive harm from exposure to [name of chemical].
OR
WARNING [or CA WARNING or CALIFORNIA WARNING]: Can expose you to [name of chemical], a carcinogen, and [name of chemical], a reproductive toxicant.
Therefore, you can refer to the above methods or visit the official website to check the names of harmful substances. Look for warning labels on the packaging and verify whether these chemicals are within reasonable limits.
This helps determine whether the product qualifies as non-toxic toys for infants, as well as for children and adults.
